BidMax provides a digital service where property owners can list their properties and potential buyers can place non-binding preliminary offers on properties. BidMax acts as a facilitator to initiate communications between property owners and potential buyers. Any agreements or transactions resulting from these communications are strictly between the buyer and the seller. BidMax is not a party to any final real estate transactions that may result from the use of this website.

Property Owners: Must ensure that all property listings provide accurate and current details of the property and comply with all applicable laws.

Buyers: Must ensure that any offer made on the website is in good faith and an accurate expression of interest in purchasing the listed property.

Users must register for an account to access certain features of the website. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. By registering, you agree to these Terms & Conditions, and further agree to receive text message and email notifications from BidMax.

You are granted a limited, non-exclusive right to access and use the website for its intended purposes. The following are strictly prohibited:

Unauthorized access to our systems or any attempt to conduct harmful acts.

Use of the website to create or promote illegal activities or conduct that is abusive, threatening, obscene, defamatory, or libelous.

All materials provided on the website, including but not limited to information, documents, products, logos, graphics, sounds, images, software, and services, are owned either by BidMax or by our respective third party authors, developers, or vendors.

BidMax will not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages resulting from your use of or inability to use the services provided on the website. BidMax facilitates preliminary communications which may lead to transactions between users but is not involved in the execution or negotiation of any final real estate transactions.

You agree to indemnify and hold harmless BidMax and its officers, directors, employees, and agents from any claims, damages, liabilities, costs, or harm arising out of your use of the website or your violation of these terms and conditions.

BidMax reserves the right to modify these terms and conditions at any time. Your continued use of the website after any such changes constitutes your acceptance of the new terms and conditions.

These terms and conditions are governed by the laws of Florida, without regard to its conflict of law provisions.

Buyer functions include, but are not limited to chatting with a seller, scheduling a showing, and making offers.

Chatting with a Seller

When you chat with a Seller, your messages are confidential to the extent that they are only available to the Seller in the portal, or by anyone who has access to a private link we send to the Seller, which may be transmitted via text message or email.  You agree that BidMax may monitor chats to ensure compliance with our Terms and Conditions, and to enhance user experience.

Scheduling a Showing

When you schedule a showing, limited information you've provided may be transmitted to the Seller and/or any licensed real estate agent involved with showing the property to you. This may include your name, photo ID, and proof of funds or pre-approval letter.  This is customary in any analog process, to demonstrate that you are a serious buyer, and for the personal safety of the Seller.  

Making an Offer

When you make an offer, limited information you've provided may be transmitted to the Seller and/or any licensed real estate agent involved with the property. This may include your name, photo ID, and proof of funds or pre-approval letter.  This is customary in any analog process, to demonstrate that you are a serious buyer.

The non-binding nature of your offer.
